IPR-driven life-cycle management strategies have become increasingly common in the pharmaceutical industry, as has their antitrust scrutiny. The technical and administrative intricacies of the pharmaceutical industry provide an apt scenario for companies to misuse legitimate rights and procedures to put in place anticompetitive strategies, posing new challenges to the sensitive interface between intellectual property and competition law. In this scenario, competition law enforcement should not be perceived as a threat to intellectual property rights: antitrust intervention is limited to those specific cases in which pathological IPR-driven LCM strategies hamper the otherwise healthy relationship that exists between competition and innovation.

This program is free and open to the public.
